• <br />• <br />• <br />Hayden Gulch Loadout <br />Response to Adequacy Comments <br />Page 5 <br />Sincerel <br />Response: The 214.7 acres is a digitized/calculated /reconciled number which Seneca has <br />been using for a number of years. The 55.7 (state - owned) acres used by the Division are <br />evidently a number that was approved during the intial permit approval process and that the <br />Division has been using ever since. Seneca also reconciled this number and has been using <br />56.1 acres which can be documented digitally. The application form doesn't need further <br />revision. <br />During this adequacy review /response, we noted that Appendix 3 -1, Permit Area Legal <br />Description Summary, contained a typo and we have included an updated copy of the <br />summary page. <br />20. The Division has compiled the attached reclamation cost estimate for the tasks associated <br />with the reclamation of the TAHR. This estimate is sufficient to reclaim all areas associated <br />with the proposed activities under PR -1. Hayden Gulch Terminal, LLC submitted a <br />reclamation cost estimate which reflected direct costs of the TAHR reclamation in the <br />amount of $203,419.00. The Division's total reclamation costs associated with these <br />activities are estimated to be $465,511.56 ($361,803.02 direct and $103, 708.54 indirect). <br />Please acknowledge if HGTI concurs with the Division's estimate. <br />Response: HGT, LLC has no objections to the Division's estimate and will provide an <br />appropriate form of surety to increase the bond by $465,512 when the PR -1 application is <br />approved. <br />21. Based on a review of the ownership and control section of the currently approved permit <br />application package for the Hayden Gulch Loadout, comparing the section with the current <br />information in the Applicant Violator System (AVS), there are numerous discrepancies that <br />will need to be addressed by Hayden Gulch Terminal, LLC............ <br />Response: Attachment 3 -2, Owner, Officer and Director Information, has been updated for <br />inclusion into the PAP. <br />During the review and response to these adequacy comments, it was noted that Exhibit 13 -11.8, <br />Tie Across Haul Road As -Built was missing from the HGT copy of the submittal.
