Failure to attend the Pre - hearing <br />Conference will result in forfeiture of party status. <br />As previously noticed, the Pre - hearing Conference is scheduled to occur on October 28, 2011, <br />at the Anasazi Room (County Commissioners Room) of the La Plata County Government <br />Building, 1060 East Second Avenue, Durango, Colorado, beginning at 1:00 p.m. and concluding <br />at or before 3:00 p.m. <br />As explained below, the Division's recommendation, if approved by the Board, ensures ample <br />opportunity for the Applicant to comply with the corrective actions of the violations, as well as <br />the corrective actions imposed by other agencies. The Division's recommendation for <br />conditional approval does not authorize the Applicant to proceed with the mining and milling <br />activities proposed in the original application for CN -01 until the permit application fully <br />satisfies the requirements of the Act and Rules. No mining or milling activities may occur until <br />the Applicant fully satisfies all corrective actions and fully demonstrates that the proposed <br />mining and milling activities will comply with the requirements of the Act and Rules. The <br />Applicant has made clear commitments that all future plans and submittals will be handled by <br />the Division as either a Technical Revision or Amendment. <br />This document provides a summary of the review process by which the Division arrived at its <br />recommendation; identifies the issues raised by the objecting parties; and defines a closely <br />regulated process whereby the Applicant may comply with corrective actions, demonstrate <br />compliance with the Act and Rules, and ultimately conduct a compliant mining and milling <br />operation. The Division reserves the right to further supplement, amend, modify, or clarify this <br />document and recommendation with additional details as necessary. <br />2 <br />
