Pirfeda <br />Director <br />Herein, all references to the Act and Rules refer to the Colorado Mined Land Reclamation Act, <br />34 -32 -101 et seq., C.R.S. (the Act or Hard Rock Act), and to the Mineral Rules and Regulations of <br />the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated Mining <br />Operations (the Rules). Copy of the current Act and Rules is available on the Division's web site <br />at www.mining.state.co.us. <br />On October 24, 2011, the Division of Reclamation, Mining and Safety (Division or Office) issued <br />its recommendation to approve with conditions, over public objection, the application to <br />convert the existing 110(2) permit to a 112d -1 operation (CN -01) for the May Day Idaho Mine <br />Complex, Permit No. M- 1981 -185. This document is intended to explain the process by which <br />the Division arrived at its recommendation to approve with conditions, over objections. <br />Through CN -01, Wildcat Mining Corporation (Applicant and Operator) attempted to satisfy the <br />corrective actions of five violations, MV- 2009 -007, MV- 2009 -033, MV- 2009 -035, MV- 2010 -001, <br />and MV- 2010 -020. The violations had been issued by the Mined Land Reclamation Board <br />(Board) for illegal activities conducted by the Operator at the May Day Mine, Permit No. M- <br />1981 -185, and at the Idaho Mill, File No. M- 2006 -069. The plans proposed through CN -01 <br />attempted to combine the affected lands from the Idaho Mill into the May Day Mine and <br />incorporate an illegal road, two illegal portals, and an illegal mill facility into the permit, and <br />update the reclamation plan and financial warranty. Additionally, through CN -01 the Applicant <br />attempted to expand the permit area from 9.9 acres to 274.7 acres, with 31.4 acres declared as <br />affected lands. <br />As previously noticed to all parties and interested persons, the Division's recommendation is to <br />the Board. The Division's recommendation will be considered by the Board during a formal <br />hearing, scheduled to occur November 9 -10, 2011, at 1313 Sherman Street, Room 318, Denver, <br />Colorado, commencing at 9:00 am, or as soon thereafter as the issue may be considered. <br />Pursuant to Rule 2.8.1(1), a party requesting to participate by telephone at the formal hearing <br />must file a written request with the Board Chair no later than 14 calendar days prior to the <br />formal hearing.
