Erickson <br />Colorado Division of Reclamation Mining & Safety <br />Durango Field Office <br />691 CR 233, Suite A -2 <br />Durango, CO 81301 <br />Re: Supplemental Response to Fifth and Sixth Adequacy Letter for a 112d -1 <br />Application, Amended CN -01, <br />Wildcat Mining Corporation, May Day Idaho Mine Complex, <br />Permit No. M- 1981 -185 <br />Dear Wally: <br />I am writing on behalf of Wildcat Mining Corporation ( "Wildcat ") to provide a <br />supplemental response to certain matters identified the Fifth and Sixth Adequacy Letters by <br />the Division of Reclamation, Mining and Safety ( "DRMS" or "Division ") for the May Day <br />Idaho Mine Complex. The last issues raised by DRMS were specific to exhibits or maps, <br />and not to past Adequacy Issue Nos. I believe some of these exhibits and maps relate to <br />parts of both the Fifth and Sixth Adequacy Letters. For continuity, I have provided our <br />supplemental responses below to the Adequacy Issues in the Fifth and Sixth Adequacy <br />Letters to which I think our revised exhibits and maps are responsive. <br />As you have requested, I have re- stated below each adequacy question presented in <br />your letter, and then provided a substantive response. For your convenience, I have <br />created one master list of attachments for Wildcat's response to your letter and these three <br />memoranda. <br />Supplemental Response to Fifth Adequacy <br />Adequacy Issue No. 2. <br />Prior to the August 9th submittal, CN -01 included 47.6 acres affected lands. In the <br />August submittal the Applicant removed 15.8 acres of lands not previously affected by <br />the mining operation. Therefore, there should have been a corresponding reduction in <br />the affected land acreage, totaling 31.8 acres. However, the August submittal indicated <br />44.23 acres affected lands, representing a reduction of only 3.37 acres. Therefore, the <br />Applicant added 12.43 acres to the boundary of affected lands.
