Jason Musick <br />- 2 - October 18, 2011 <br />concern with proposed disturbed area runoffflowing into undisturbed areas untreated. The <br />northern boundary of the proposed additional disturbed area will need to provide adequate runoff <br />diversions to ensure that all disturbed area runoff is treated before leaving the disturbed area. <br />Please provide any revised text, exhibits, or maps describing the manner in which New Elk <br />Coal Company will comply with the requirements 4.05.2(1). <br />NECC - During a joint field inspection with DRMS and NECC representatives it was determined <br />the flow from the C & W train shop and 10 stall garage is contained and will generally flow to <br />ditches D -5 and D -6. New Map 13C shows the ditches in the subject area. Map 11, Sheet 1 was <br />revised to depict the access roads that run to and around the C & W train shop. <br />2. DRMS - Regarding proposed revised pages 2.05 -27, 2.05 -27a, and 2.05 -6a (Table 19), proposed <br />revised Map 11 -Sheet 3, and proposed revised Exhibit 28, please have New Elk revise these <br />materials to remove references to the 200' fixed conveyor, the 500' temporary conveyor, and <br />demolition and mob /demo associated with the radial stacker pads and conveyor footings. It's my <br />understanding that these pieces of equipment will be addressed via Minor Revision MR97, which <br />the Division is also currently reviewing. <br />NECC - Please withdraw pages 2.05 -27 and 2.05 -27a from further consideration in this technical <br />revision. These two pages only describe the refuse conveyors and are included in MR -97. <br />Enclosed are amended Table 19 and Map 11 -Sheet 3. <br />Division response: This response is adequate. <br />3. DRMS - The Division has compiled a reclamation cost estimate for the tasks associated with the <br />reclamation of the C &W Train Shop Facilities Area. This estimate is sufficient to reclaim all areas <br />associated with the proposed addition offacilities under TR59. Based on discussions with New <br />Ells the proposed 200 ft fixed conveyor, 500 ft temp. conveyor and demolition work associated <br />with the radial stacker pads and conveyor footings will be bonded under Minor Revision MR97. <br />As such, those tasks have not been included in the Division's cost estimate. New Elk submitted a <br />reclamation cost estimate in the amount of $158, 716, which included those tasks omitted in the <br />Division's estimate. The Division's total reclamation costs associated with these activities are <br />estimated to be $119,730.94. Please have New Elk acknowledge if they concur with the Division's <br />estimate. <br />NECC - The DRMS' reclamation estimate was incorporated into NECC's Exhibit 28. NECC <br />accepts the $119,730.94 reclamation estimate. <br />Division response: This response is adequate. Please note that a revision to the reclamation cost <br />estimate may be required based on NECC's response to adequate comment no. 1. <br />Sincerely, <br />J. E.
