MANAGEMENT <br />The DRMS' letter dated October 6, 2011 transmitted its second adequacy response for the referenced <br />technical revision. On behalf of New Elk Coal Company (NECC) following are its responses to the <br />DRMS' comments and concerns. <br />1. DRMS - Based on a review of the approved Map 13 in the PAP, the proposed disturbance area <br />runoff of the addition requested in TR59 is not delineated. Please have New Elk discuss the <br />manner in which the proposed disturbed area runoff will be collected and treated. <br />NECC - The C & W train shop, 10 stall garage and other associated structures are located on the <br />west side of the east mine sedimentation control system. The land slopes approximate 2% from <br />the C & W train shop to the east towards pond 7. Flow from this general area will be collected in <br />either ditch D -5 or D -6 and will be conveyed to sediment pond 7. The forth paragraph on page <br />2.05 -10 was inserted to explain this issue. <br />Division response: Based on the information on revised page 2.05 -10 submitted with the New Elk <br />Coal's adequacy response, approved Map 13, and the information on approved Table 20 <br />concerning ditches D -5 and D -6, the runoff from the proposed additional 6 acres of disturbance <br />will not reach ditch D -5 or D -6. The Division concurs that the proposed area may slope <br />approximately 2% to the east. However, it appears that any runoff through the disturbed area <br />would flow north and west, with the runoff at the extreme western edge of the area possibly <br />draining to the west. <br />It appears that, in order for runoff from the southernmost portion of the area to reach ditch D -6, <br />the runoff would be required to cross ditch D -7 which conveys undisturbed area runoff or flow <br />over the small area of road over culvert C -3. In addition, if it were the case that all runofffrom <br />the area were to reach ditches D -5 and D -6, the runoff would be required to flow over the small <br />section of road (and be contained on the road surface) over culvert C -3. <br />The Division believes that it would be unlikely that all surface runoff will flow into ditches D -5 <br />and D -6. The western most portion of the area behind and around the buildings is of particular <br />
