• <br />• <br />• <br />13.3 OWNER shall have the right to terminate this MINING LEASE if LESSEE does <br />not correct or commence to correct with diligence such default within sixty (60) days from <br />receipt of notice granted in 13.1 above if such default is for other than a monetary payment <br />default. <br />13.4 If such default in 13.2 and 13.3 above is not corrected within the time specified, <br />then OWNER may terminate this MINING LEASE immediately by written notice to LESSEE, <br />and such termination shall be effective immediately upon receipt of such notice of termination by <br />s: klientlhendrickslcalaisgensmith mining lease.rtf <br />10 <br />LESSEE. <br />13.5 Should this MINING LEASE be terminated under the provisions of this Provision <br />XIV., then LESSEE shall have ninety (90) days to remove its mining equipment or buildings <br />from the Leased Premises, except that such buildings, property, or equipment may not be <br />removed from the Leased Premises should LESSEE be in default of any payment to OWNER. <br />LESSEE agrees, upon termination, to execute any required release or termination to clear title to <br />the properties in the official records of Boulder County, Colorado. Termination shall relieve <br />LESSEE of any future obligation to make payments of advance minimum royalty not due and <br />payable as of the date of termination. <br />XIV. TERMINATION BY LESSEE <br />14.1 LESSEE may terminate this MINING LEASE upon sixty (60) days written notice <br />to OWNER, and shall be relieved thereby of any future obligations to pay rentals or royalties <br />except obligations previously accrued. <br />14.2 Unless otherwise directed by OWNER, LESSEE shall diligently perform all <br />required reclamation work on the Leased Premises. LESSEE shall be allowed to continue <br />seeding and/or watering of existing reclaimed areas after the termination date. <br />
