See Ex. 5; see also Response to September 27 Cazier <br />Memo, Adequacy Issue No. 11. <br />Adequacy Issue No. 11. <br />This response is inadequate. The values in Table U -6 and p. 7 of Attachment 6.5 do not <br />match as summarized below: <br />DEN 97,629,168v1 10 -11 -11 <br />encountered. Samples will be inspected to confirm field <br />classifications and for laboratory testing; <br />o Selected samples will be transported for laboratory testing <br />including testing for moisture content, dry density, <br />strength, classification, grain -size distribution, and <br />compaction tests. <br />o Perform engineering and geologic evaluations to develop <br />conclusions and recommendations regarding the <br />following: <br />• Stability of the Chief Portal and the adjacent <br />bench, and hydraulic assessment of the potential <br />for the Little Deadwood Gulch drainage to impact <br />bench stability; <br />• Design criteria for methods to stabilize or reclaim <br />the Chief Portal and the adjacent bench, as <br />necessary. <br />o Prepare a technical memorandum summarizing the results <br />of the work described above. <br />o Submit revised design plans for stabilization of the Chief <br />Portal and the adjacent bench, including repair drawings <br />and specifications, or revised reclamation plans and maps, <br />as necessary, through the Technical Revision or <br />Amendment process. <br />o After obtaining DRMS approval through the Technical <br />Revision or Amendment process, proceed with remainder <br />of work plan. <br />GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW ® WWW.GTLAW.COM <br />
