This
memorandum follows up on adequacy issues raised by Mr. Cazier in a previous
memorandum dated August 19, 2011. As you have requested, I have re- stated below
each adequacy question, and then provided a substantive response.
Adequacy Issue No. 1.
This response is inadequate. DRMS did not receive a new Attachment D -2, Figure D -4.
DRMS did receive a new Attachment D -2, Figure D -1A that indicates there will be 21
sets in the area labeled "Mill Building ". However, this new figure does not delineate the
"point of contact of the unconsolidated material and the bedrock" as described in the
response. Please submit the aforementioned "point of contact" Attachment D -2, Figure
D -4.
Response to Adequacy Issue No. 1.
Wildcat is submitting a copy of the existing mill structure illustrating the location
of the mill in relationship to the collapsed portal (Attachment D -2, Figure D -4.) See Ex.
11. Because the portal is collapsed, Wildcat cannot delineate the "point of contact" until
the portal excavation task has been completed. Wildcat will add a sub - bullet under the
fourth bullet on Page 4 of Attachment D -2 as follows:
• Location of point of contact of the unconsolidated material and the bedrock.
DEN 97,629,168v1 10 -11 -11
GREENBERG TRAURIG, LLP a ATTORNEYS AT LAW a WWW.GTLAW.COM
The Tabor Center a 120017th Street Suite 2400 a Denver, CO 80202 m Tel 303.572.6500 a Fax 303.572.6540
