Mr. Wallace H. Erickson
Response to September 23, 2011 Hays Memorandum
October 11, 2011
Page 2
Response to Adequacy Issue No. 2.
Wildcat's response is accurate, except that "Figure 5" should be deleted from the
reference to Figure 6.5 -3. The reference at Page 4, second full paragraph, is to
Attachment 6.5.3, which is entitled, "Report, Geotechnical Reconnaissance, Idaho Mine
Access Road (May 29, 2010)." The reference at Page 5, Pre - Construction Activities,
second bullet, is to Figure 6.5 -3, which is located at the end of Exhibit 6.5 and is
entitled, "Access Road Boring and Test Pit Location." Wildcat is submitting a copy of
Figure 6.5 -3 for ease of reference. See Ex. 10.
Adequacy Issue No. 3.
In response to adequacy issue no. 7, the Applicant states Wildcat will correct the
reference to Attachment 6.5 -3 Figure 5 to "Exhibit 6.5 -3 ". The Division did not receive
Exhibit 6.5 -3. Did the Applicant intend to refer to Figure 6.5 -3 labeled Access Road
Boring and Test Pit Location? If so, please revise the reference in the work plan.
Response to Adequacy Issue No. 3.
Wildcat intended to refer to Figure 6.5 -3 labeled Access Road Boring and Test
Pit Location, and will revise this reference in the work plan.
Adequacy Issue No. 4.
In response to adequacy issue no. 8, the Applicant states the locations of the test borings
proposed by Wildcat are shown on Exhibit 6.5 -3. See question #3 above. If the
Applicant intended to refer to Figure 6.5 -3, the location of the borings and test pits not
located in the road are illegible due to the size of the map and contour line spacing used
by the Applicant. Please provide a legible access road boring and test pit location map
for Division review.
Response to Adequacy Issue No. 4.
See supra Response to Adequacy Issue Nos. 2 and 3. Wildcat is providing a
legible copy of Figure 6.5 -3. See Ex. 10.
Adequacy Issue No. 5.
The Applicant responded to a majority of the Division's adequacy items, by committing to
submit new geotechnical investigation information, with a revised road design, for Division
review and approval through either the Technical Revision or Amendment process prior to
commencing access road reconstruction activities. No access road work plan or
construction may be implemented without Division review and approval.
DEN 97,629,160v1 10 -11 -11
GREENBERG TRAURIG, LLP ® ATTORNEYS AT LAW ® WWW.GTLAW.COM
