Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed New Elk Coal <br />Company's responses to the adequacy items which the Division identified in an adequacy e-mail sent <br />on September 28, 2011. The Division received New Elk's response to our comments on October 4, <br />2011. The Division's responses to New Elk Coal's comments concerning adequacy items identified by <br />the Division are below. <br />1. Division initial comment: Based on a review of the approved Map 13 in the PAP, the proposed <br />disturbance area runoff of the addition requested in TR59 is not delineated. Please have New <br />Elk discuss the manner in which the proposed disturbed area runoff will be collected and <br />treated. <br />New Elk Coal response: The C & W train shop, 10 stall garage and other associated structures <br />are located on the west side of the east mine sedimentation control system. The land slopes <br />approximate 2% from the C & W train shop to the east towards pond 7. Flow from this general <br />area will be collected in either ditch D -5 or D -6 and will be conveyed to sediment pond 7. The <br />fourth paragraph on page 2.05 -10 was inserted to explain this issue. <br />Division response: Based on the information on revised page 2.05 -10 submitted with the <br />New Elk Coal's adequacy response, approved Map 13, and the information on approved <br />Table 20 concerning ditches D -5 and D -6, the runoff from the proposed additional 6 acres <br />of disturbance will not reach ditch D -5 or D -6. The Division concurs that the proposed <br />area may slope approximately 2% to the east. However, it appears that any runoff <br />through the disturbed area would flow north and west, with the runoff at the extreme <br />western edge of the area possibly draining to the west. <br />It appears that, in order for runoff from the southernmost portion of the area to reach <br />ditch D -6, the runoff would be required to cross ditch D -7 which conveys undisturbed <br />area runoff or flow over the small area of road over culvert C -3.
