Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (DRMS) engineering staff has reviewed the <br />September 9, 2011 responses ( "Response to August 19, 2011 Cazier Memorandum ") provided <br />by Greenberg Traurig to DRMS comments addressing Geotechnical Stability Exhibit comments <br />of the August 2011 submittal. The comments provided in this memorandum are posed to ensure <br />adequate engineering analyses and design practices are implemented in accordance with Rule <br />6.5 <br />For clarity, DRMS references the Greenberg Traurig "Adequacy Issue No." for each of the <br />following comments: <br />Adequacy Issue No. 1: This response is inadequate. DRMS did not receive a new Attachment <br />D -2, Figure D -4. DRMS did receive a new Attachment D -2, Figure D -1A that indicates there <br />will be 21 sets in the area labeled "Mill Building ". However, this new figure does not delineate <br />the "point of contact of the unconsolidated material and the bedrock" as described in the <br />response. Please submit the aforementioned "point of contact" Attachment D -2, Figure D -4. <br />Adequacy Issue No. 2: The applicant has committed to resolving this adequacy issue. <br />However, they have not committed to addressing this adequacy issue in a TR or AM. Please <br />provide a written commitment to resolve this adequacy issue via the TR or AM process: The <br />revised text and five bulleted responses to this adequacy issue presented in the subject response <br />letter shall be included in the revised Geotechnical Stability Exhibit. <br />Adequacy Issue No. 3: The response to this issue is considered adequate. <br />Adequacy Issue No. 4: This response is inadequate. DRMS has previously reviewed the May <br />29, 2010 report and found it to be inadequate. <br />Adequacy Issue No. 5: The applicant has committed to resolving this adequacy issue. <br />However, they have not committed to addressing this adequacy issue in a TR or AM.
