The Division has reviewed and accepts the 2 -Dam Grouting and 3 -Dam Seep Water Management <br />documents. The Operator has fulfilled the requirements of Rule 7.3 and Stipulation No. 1, 3 and 4 <br />of TR -9. The revised terms of Technical Revision No. 9 approved by the Division are hereby <br />incorporated into Permit No. M- 1977 -342. All other conditions and requirements, including <br />Stipulation No. 2 for TR -2, of Permit No. M- 1977 -342 remain in full force and effect. <br />If you have any questions, please contact me at (303) 866 -3567 Ext. 8124. <br />Sincerely, <br />2 <br />Stipulation No. 4 — Technical Revision 9 <br />The penetration of No. 3 -Dam by the abandoned No. 2 -Dam decent system could <br />create a pathway for seepage and piping which are potential dam stability issues. <br />Within 60 days of date of technical revision TR -09 approval, Henderson must <br />provide the Division with a report on this potential, which may comprise records on <br />the construction of No. 3 -Dam as they relate to the decant system penetrations, or <br />if adequate historical records are unavailable Henderson must provide the Division <br />with a proposal to investigate the nature and condition of the decant system <br />penetrations. <br />Peter S.
