This SWSP shall be valid for the period of January 1, 2011 through December 31, 2011, unless <br />otherwise revoked, modified, or superceded by decree. If this plan will not be made absolute by <br />a water court action by the plan's expiration date, a renewal request must be submitted to this <br />office with the statutory fee (currently $257) by November 15, 2010. <br />2. Well permit no. 65812 -F (WDID 0403007) was obtained for the current use and exposed pond <br />surface area of the gravel pit in accordance with §37-90-137(2) and (11), C.R.S. <br />3. The total surface area of the groundwater exposed at the Bernhard Pit must not exceed 3.82 <br />acres during the approval period of this SWSP resulting in an annual evaporative loss of 11.01 <br />acre -feet. <br />4. The annual amount of water used at the operation shall not exceed 3.33 acre -feet for dust control <br />and the amount used for concrete production shall not exceed 1.23 acre -feet used in the <br />production of 10,000 tons of concrete. <br />5. Total consumption at the Bernhard Pit must not exceed the aforementioned amounts unless an <br />amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this water <br />must first be approved by this office. <br />7. The applicant shall maintain daily records of all diversions, replacements, and the amount of <br />water used for each particular purpose. The applicant shall provide a report of these records to <br />the division engineer and the water commissioners on a monthly basis on a form approved by <br />them. The accounting must be submitted within thirty (30) calendar days of the end of the <br />month for which the accounting is being made. <br />In addition, the applicant shall verify that the Town of Milliken ( "Milliken ") has submitted a report <br />to the Division Engineer that includes an accounting of all replacement water controlled by <br />Milliken, showing the total volume of water under its control and the amount committed to each <br />of the recipients of the water, including the water committed to this plan. <br />8. All diversions shall be measured in a manner acceptable to the division engineer. The <br />Applicant shall install and maintain such measuring devices as required by the division engineer <br />for operation of this SWSP. <br />9. All releases of replacement water must be sufficient to cover all out of priority depletions and be <br />made under the direction and /or approval of the water commissioner. The replacement may be <br />aggregated to maximize beneficial use. The water commissioner and /or division engineer shall <br />determine the rate and timing of an aggregated release. <br />10. The name, mailing address, and phone number of the contact person who will be responsible <br />for operation and accounting of this plan must be provided on the accounting forms to the <br />division engineer and water commissioner. <br />11. Adequate accounting of depletions and replacements must be provided to the division engineer <br />in Greeley (Div1Accountinq(c�state.co.us) and the water commissioners (Jason Smith at <br />Jason.Smith2astate.co.us and Scott Edgar at William .Schneider(a,state.co.us) on a monthly <br />
