Prior to the August 9 submittal, CN -01 included 47.6 acres affected lands. In the <br />August submittal the Applicant removed 15.8 acres of lands not previously affected by <br />the mining operation. Therefore, there should. have been a corresponding reduction in <br />the affected land acreage, totaling 31.8 acres. However, the August submittal indicated <br />44.23 acres affected lands, representing a reduction of only 3.37 acres. Therefore, the <br />Applicant added 12.43 acres to the boundary of affected lands. As shown in Table 1, the <br />increase occurred primarily with an expansion of the affected land boundaries for the <br />New Access Road and Pre - existing Roads. <br />le 1: Affected Land Acrea as provided in Exhibit A of the Application <br />Pursuant to Rule 1.1(6), the August submittal constitutes an Amendment to CN - 01. If <br />the Applicant intended to expand the boundary of affected lands, please complete the <br />filing process as required for the previous amendment to CN -01, filed April 27, 2011. <br />Alternately, if the Applicant did not intend to expand the boundary of affected lands, <br />please correct the application to reflect no increase in affected lands. <br />3. The expanded boundary of affected lands must include all 9.9 acres of the existing <br />permit. All affected lands of the existing permit must be addressed by the reclamation <br />plan and financial warranty proposed under CN -01. <br />Figure D -1 of Attachment D -2, and Figure F -1 show portions of the existing mine bench <br />and highwall located outside of the new boundary of affected lands. Figure F -1, May <br />Day 1 Reclamation Topography, indicates the portions of affected lands, which are <br />located outside of the new boundary, will not be reclaimed. <br />2 <br />
