PERMIT #: M- 2006 -078 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: September 1, 2011 <br />Sediment Control: <br />At the time of the inspection the landowner was diverting water from the Godding Ditch, located on the east <br />side of the site, into the southeast corner of the pit. The pit slope in the area of the discharge point is not <br />protected with riprap or other types of energy dissipaters. As a result, gullies are forming at the point of <br />discharge and the pit wall is beginning to back -cut. The erosion of the pit wall is considered a problem and will <br />require corrective action by the Operator; please see the first page of this report for additional information. <br />Based on the observations of this inspection the Operator has not satisfied the requirements of the approved <br />Reclamation Plan or the Construction Materials Rules and Regulations. Therefore, the Division is unable to <br />approve the request for a full performance and financial warranty release. Notice of the Division's decision <br />regarding the release request will be sent under separate cover. <br />The Division holds a financial warranty in the amount of $127,000.00, which is sufficient to complete <br />reclamation. The Operator may file a written notice of completion of reclamation and request for release of <br />reclamation responsibility with the Office once the above reclamation has been completed. <br />This concluded the inspection. <br />Page 3 of 5 <br />
