OBSERVATIONS <br />PERMIT #: M- 2006 -078 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: September 1, 2011 <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Justin DuMond of Flatiron Constructors, Inc. was also present for the inspection. The Camenish <br />Borrow site is located 0.25 miles north of Frederick, Colorado. The site is permitted for 30 acres and the post - <br />mining land use is developed water resource. <br />The Division conducted this inspection in response to a request for full performance and financial warranty <br />release received on August 8, 2011. The Camenish Borrow pit was operated under a Construction Material <br />Special 111 Reclamation Permit and the borrow material was used by the Colorado Department of <br />Transportation for the 1 -25 Widening Project No. IM- 0253 -160. Mining of the Camenish Borrow site was <br />completed in 2008. <br />Reclamation Success: <br />The extraction of sand and gravel reached a depth of approximately 20 feet. A gas well, owned by Kerr McGee, <br />is located near the center of the pit. A strip of land approximately 50 feet in width was left in place to allow <br />access to the gas well, which resulted in a horse shoe shaped pit. According to the approved Reclamation Plan <br />Map, the gas well was to be accessed from the north perimeter of the pit. However, the gas well is now <br />accessed from the east perimeter of the pit. The change in the site configuration is considered a problem and <br />will require corrective action by the Operator; please see the first page of this report for additional <br />information. <br />The pit was sealed with a compacted clay liner and the side slopes were graded to 3H:1V. The Operator <br />successfully passed the 90 -day leak test required by the Office of the State Engineer and demonstrated that <br />the compacted clay liner met the appropriate design standards. Documentation of the clay liner approval was <br />provided to the Division on August 18, 2011. <br />The Division observed a small stockpile of aggregate material located on the east side of the pit. The Operator <br />informed the Division that the material was left in place at the request of the landowner. The material may <br />remain in place if the Operator provides the Division with a signed and notarized statement from the <br />landowner which authorizes the Flatiron Constructors, Inc. to leave the aggregate stockpile on the property. <br />Revegetation: <br />The Operator drill- seeded the site with the dry land seed mix in August of 2009. The vegetation was beginning <br />to establish throughout the site; however, the planted grasses are not capable of self regeneration without <br />further aid at this time. The drill rows are still visible in certain areas and the vegetation is sparse to absent on <br />the pit side slopes. Vegetation will need to be established on the side slopes of the pit or the Operator will <br />need to demonstrate to the Division that the landowner's water rights are sufficient to fill the pit. If the pit will <br />contain water on a continued basis, then vegetation will need to be established to the extent of the highwater <br />line. The landowner grazes cattle within the reclaimed area; no cattle were present at the time of the <br />inspection. It is not known how long the cattle have been grazing in the reclaimed area; the Operator should <br />work with the landowner to keep the cattle out of the reclaimed area until the site is released from further <br />reclamation responsibility. The Division recommends the Operator inter -seed the site this fall with the dry <br />land seed mix; at least one more growing season will be required to allow the vegetation to establish <br />throughout the site. <br />Page 2 of 5 <br />
