Mr. Wallace H. Erickson
Response to August 23, 2011 Bird Memorandum
September 9, 2011
Page 3
Dry Stacked Tailings Work Plan, as necessary, to DRMS through either the
Technical Revision or Amendment process, as appropriate.
• Coordinate schedules with DRMS, and offer its representatives the
opportunity to inspect the proposed locations for underground dry stacked
tailings disposal;
• After obtaining DRMS approval through the Technical Revision or
Amendment process, proceed with remainder of work plan.
Response to Adequacy Issue No. A.2.
Wildcat, when authorization is obtained, will map seeps within working adits and
drifts. Mapping will be conducted during the spring or early summer. When necessary,
Wildcat will commit to consolidation grouting of fractures or other weak zones if the
seepage has the potential to come into contact with the disposed tailings.
Response to Adequacy Issue No. A.3.
Wildcat will modify Attachment D -5 under "Field Management" to reflect that
the first water sampled must include the complete ground water analytical suite, and that
the analytical suite for later samples may be pared down depending upon the results of
the earlier sampling and only with DRMS approval.
Response to Adequacy Issue No. A.4.
Dewatered tailings will be hauled to the designated disposal areas using muckers
and or skid steers.
Adequacy Issue No. B. Attachment D -6, Augmentation Pond Construction Work
Plan
Since the pond is not lined, the Applicant must provide a commitment that no water
other than Idaho Spring water will be diverted into the pond. Storm water and overland
flow water must be diverted around the pond.
Response to Adequacy Issue No. B.
Wildcat will clarify Attachment D -6 to reflect that it will construct the
augmentation pond either with on site cohesive soils or with an appropriate geosynthetic
liner, with final design submitted through the Technical Revision or Amendment
process. The pond will only be used to store raw water for augmentation purposes per
the Division of Water Resources permit and water court stipulations. Surface water will
be diverted around and away from the augmentation pond in accordance with the
DEN 97, 591, 783v2 9 -9 -11
GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM
