Mr. Wallace H. Erickson
Response to August 19, 2011 Cazier Memorandum
September 9, 2011
Page 8
velocity. DRMS cannot verify channel design based on information in Table U -11, or
from pages immediately preceding or following Table U -11.
Response to Adequacy Issue No. 11.
Wildcat will correct this reference. The reference should be to Table U -6.
Adequacy Issue No. 12.
Page 8, Augmentation Pond, second to last paragraph. The first line states
"Embankment slopes will not be steeper than 1 (H) to 1 (V) without DRMS approval . .
. ". This is incorrect. DRMS will require slope stability analyses addressing a)
empty /dry conditions, b) full capacity conditions, and c) rapid draw down conditions for
any embankment design to impound water with slopes greater than 3H:1V.
Response to Adequacy Issue No. 12.
Wildcat is providing a work plan to obtain samples of native construction
material which will be excavated at the location of the proposed augmentation pond and
used to construct the pond. See Exhibit 6.5, Figure 6.5 -4; Attachment D -6. Wildcat
presents in its work plan an approach to obtain samples, analyze the geotechnical
properties of the construction material, and to perform the analyses requested by DRMS.
Wildcat commits to providing this analysis, and any design changes, to DRMS for
review and approval through the Technical Revision or Amendment process.
Adequacy Issue No. 13.
Page 9, fourth paragraph. The applicant indicates that because the embankment height is
less than 10 feet "the concern for dam failure through an engineered constructed berm is
not probable. DRMS is concerned with a berm failure in this instance with respect to
impacts to the hydrologic balance, pursuant to Rule 3.1.6.
Response to Adequacy Issue No. 13.
See Response to Adequacy Issue No. 12.
DEN 97,591,785v2 9 -9 -11
GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM
