Erickson <br />Response to August 22, 2011 Hays Memorandum <br />September 9, 2011 <br />Page 4 <br />Response to Adequacy Issue No. 4. <br />Response to Adequacy Issue No. 4.a. <br />Wildcat will delete this sentence from the Purpose section of the Work Plan. <br />Wildcat has proposed in the Pre - Construction Activities section of its New Access Road <br />Work Plan to perform an engineering and geologic evaluation of the proposed cut slopes <br />on the New Access Road. Wildcat has proposed this evaluation to confirm the viability <br />of its proposed design, and it will submit any revisions to its proposed design necessary <br />to address slope stability matters, as necessary, through the Technical Revision or <br />Amendment process. <br />Wildcat will clarify its intent by modifying the first sub - bullets under the fourth <br />bullet of the Pre - Construction Activities section on Page 5 of the New Access Road <br />Construction Work Plan to read as follows: <br />• Stability of cut slopes in rock and colluvium areas, including: <br />• Stability of cut slopes steeper than 1.25(H):1(V); <br />• Stability of cut slopes between Sta. 16 +00 and Sta. 19 +00, which <br />vary from slightly flatter than 1:1 to near vertical, i.e., between <br />0.4:1 and 0.14:1, including whether these slopes will remain <br />stable if flattened to 1:1 using an excavator; and, <br />• Stability of cut slopes between Sta. 19 +00 and Sta. 21 +00, <br />including whether these slopes will remain stable if steepened to a <br />maximum slope ranging from 0.5:1 to 1:1. <br />Wildcat will further clarify its intent by adding the following bullets after the <br />fifth bullet of the Pre - Construction Activities section on Page 5 of the New Access Road <br />Construction Work Plan: <br />• Submit technical memorandum with updated analysis and any modified <br />design for the New Access Road or for riprap specified in work plans or in <br />the Stormwater Management Plan (Exhibit U, Attachment U -3), as necessary, <br />to DRMS through either the Technical Revision or Amendment process, as <br />appropriate. <br />• After obtaining DRMS approval through the Technical Revision or <br />Amendment process, proceed with remainder of work plan. <br />DEN 97,591,784v1 9 -9 -11 <br />GREENBERG TRAURIG, LLP • ATTORNEYS AT LAW • WWW.GTLAW.COM <br />
