Erickson <br />Response to Fifth Adequacy <br />September 9, 2011 <br />Page 17 <br />o Wildcat will modify the Design Specifications, Designated Chemical <br />Storage, May Day No. 1 Affected Area section at Page 18 of Exhibit U, by <br />adding the following language to the end of the "Pipelines for tailings and <br />recycled process water" bullet: <br />DEN 97,599,531v1 9 -9 -11 <br />• Wildcat will implement the following work plan to develop design <br />specifications, to construct and to obtain licensed professional engineer <br />certification of the Pipelines for tailings and recycled process water as an <br />Environmental Protection Facility: <br />• Following completion of Portal Collapse Repair Work Plan, <br />Attachment D -2, prepare design for pipelines for tailings and recycled <br />process water; <br />• Submit revised design plans for the pipelines for tailings and recycled <br />process water through the Technical Revision or Amendment process; <br />and, <br />• After obtaining DRMS approval through the Technical Revision or <br />Amendment process, proceed with remainder of work plan, perform <br />scope of work to construct the pipelines for tailings and recycled <br />process water, and obtain licensed professional engineer certification <br />of the pipelines for tailings and recycled process water as <br />Environmental Protection Facility. <br />• Recycled process water storage tanks. <br />o See supra bullet regarding location of dewatering of tailings. The recycled <br />process water storage tanks are located in the Filter Press Building and will <br />be constructed and certified as Environmental Protection Facilities in the <br />same manner as the location for dewatering of tailings. <br />• Tailings disposal and /or storage locations. <br />o Wildcat has shown the location of the proposed location for tailings disposal <br />on maps at Exhibit D, Figure D -4. <br />o Wildcat will modify the Design Specifications, Designated Chemical <br />Storage, Underground workings section at Page 19 of Exhibit U, by adding <br />the following language to the end of the "Tailings disposal locations" bullet: <br />• Wildcat will implement the following sub -work plan during <br />implementation of the Dry Stacked Tailings Work Plan, Attachment D -5, <br />to develop design specifications, to construct and to obtain licensed <br />GREENBERG TRAURIG, LLP ® ATTORNEYS AT LAW o WWW.GTLAW.COM <br />
