August 23, 2011 <br />C- 2009- 087/Peabody Sage Creek Mine <br />JDM <br />approved disturbance area and in the locations permitted. <br />OTHER (SPECIFY): <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of Reclamation, Mining and Safety <br />(Division). Oblique aerial photographs were taken on August 23, 2011 and reviewed in the Denver office by <br />Jason Musick of the Division on August 25, 2011. The weather was clear and the site appeared dry at the time of <br />the inspection. The photographs displayed evidence of construction of facilities in and around the area of the <br />approved southern facilities area and areas of reclamation throughout the site. <br />ROADS — Rule 4.03; Construction 4.03.1(3)/4.03.2(3); Drainage 4.03.1(4)/4.03.2(4); Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6); Reclamation 4.03.1(7)/4.03.2(7): <br />Haul roads E -1, D and access road E -2 were stable with no problems noted. Construction of permitted Haul Road <br />D extending from Road B to the area of the Southern Coal Handling Facilities continues. Road D appears to be in <br />the location permitted and reflects the approved configuration displayed on Map 2.05.3M 1 A in the PAP. No <br />problems were noted on or around the access roads identified in the photographs. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />The area of reclamation associated with the SL -1 application submitted on June 8th, 2011 is stable with no <br />evidence of erosion or instability. The reclamation appears well vegetated with substantial vegetative cover and <br />no erosional damage observed. <br />TOPSOIL — Rule 4.06; Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3; <br />Redistribution 4.06.4: <br />Topsoil stripping in the area of the southern Coal Handling Facilities appears to be complete. It appears that the <br />topsoil is being stockpiled in the approved location. This is consistent with statements made by SCM personal <br />during the on- the - ground inspections. The lone topsoil pile is near completion with remaining topsoil striping to <br />occur in the area of the temporary coal handling facilities area/material storage area and any topsoil remaining for <br />associated ditches and sumps. <br />Number of Partial Inspection this Fiscal Year: 4 <br />Number of Complete Inspections this Fiscal Year: 0 <br />Page 3 of 8 <br />
