Pineda <br />CAM Colorado, LLC Director <br />2352 N 7"' Street, Unit C <br />Grand Junction, CO 81501 <br />Re: Fruita Loadout (Permit No. C -2010 -088) <br />New Permit Application, Adequacy Review No. 4 <br />Dear Mr. Heaps: <br />The Division of Reclamation, Mining and Safety (Division) has reviewed CAM Colorado, LLC's <br />(CAM's) third adequacy response letter for the Fruita Loadout new permit application. CAM's <br />third response was received by the Division on August 22, 2011. The Division has the following <br />remaining comments based on CAM's responses to the items listed in our August 10, 2011 third <br />adequacy review letter. Please note that there are several new questions as a result of the recent <br />plan changes. These are Items through A through M listed below at the end of this letter. <br />if As of August 4, 2011 Henry Scholder is still listed as a Vice President of <br />Wexford Capital LLC in AVS. Please revise Page 2.03 -19 to include Henry Scholder <br />as an officer of Wexford Capital LLC. Also, CAM shows Thomas Hanley as a Vice <br />President of Wexford Capital, LLC. AVS has him end dated as of 91412009. Which <br />is correct? Please update Page 2.03 -19 accordingly. <br />13. Rule 2.04.7(2)(a) requires that the baseline surface water data show seasonal variations in <br />the quantity and quality of the surface water. However, only two quarters of the baseline <br />surface water data are presented in Exhibit 3 of Volume 11. Please submit additional <br />baseline surface water data in compliance with Rule 2.04.7(2)(a). <br />In Exhibit 3 of the submittal dated August 19, 2011, CAM provided three consecutive <br />quarters of baseline surface water monitoring data for the Lower Downstream Loma <br />Drain monitoring site. Please provide the third quarter 2011 data when obtained in <br />order to complete the baseline surface water data for this site. <br />47.1 Please provide revised permit text, maps and hydrology designs that take into account <br />that the borrow area, borrow area topsoil stockpile and pond 4 will be deleted from the <br />Fruita Loadout plan, that there will be three sediment ponds and that sediment control for <br />the portion of the railroad loop adjacent to the deleted borrow area will not involve a <br />sediment pond. <br />Office of <br />Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
