#1 — The NH2 and NHN mines have two different permits and the species diversity standards
need to be listed separately in each permit. It is understandable that the standards will be the
same for both permits, however, for consistency, accuracy and autonomy between permits,
please include the appropriate language for the species diversity standard in the NHN permit
instead of referring to the NH2 permit.
#2 — Item Resolved
#3 — Item Resolved
#4 - Please resubmit Table 2.04.10 -9 — Irrigated Pasture Cover on page 14 of the appendix.
Part of this table is obstructed and the data is not legible.
#5 — Item Resolved
#6 — Item Resolved
Rule 2.04.12 — Prime Farmland Investigation
#1 — Item Resolved
Rule 2.05.4(2)(c)
#1 — Item Resolved
#2 — Item Resolved
#3 — Item Resolved
Rule 2.05.4(2)(d) — Removal, Storage and Redistribution of Topsoil and Subsoil
#1 — Item Resolved
#2 — Item Resolved
#3 — WF -C's response was that NH2 apparently is the only mine in Colorado required to
salvage A horizon separately for B horizon soils. The Keenesburg Mine salvaged A horizon
soils in separate lifts from the B horizon soils. This mine is no longer salvaging topsoil, but
the operator replaces topsoil in separate lifts. Please provide a discussion that demonstrates
to the Division that salvage of topsoil and subsoil in one combined lift so that "all areas
affected by surface coal mining operations shall be restored in a timely manner to conditions
that are capable of supporting the uses which they were capable of supporting before any
mining or to higher or better uses achievable under criteria and procedures of 4.16" (Rule
4.16.1(1)).
2
