All of my questions have been <br />answered satisfactorily. Only the 3rd quarter baseline surface water monitoring results for the <br />Lower Down Stream Loma Drain site need to be submitted. The following is the status of my <br />remaining questions and comments: <br />13. Rule 2.04.7(2)(a) requires that the baseline surface water data show seasonal variations <br />in the quantity and quality of the surface water. However, only two quarters of the <br />baseline surface water data are presented in Exhibit 3 of Volume II. Please submit <br />additional baseline surface water data in compliance with Rule 2.04.7(2)(a). <br />In Exhibit 3 of the submittal dated August 19, 2011, CAM provided three consecutive <br />quarters of baseline surface water monitoring data for the Lower Downstream Loma <br />Drain monitoring site. Please provide the third quarter 2011 data when obtained in order <br />to complete the baseline surface water data for this site. <br />CAM noted the comment. The 3 quarter 2011 data will be submitted when it is <br />obtained. <br />47. 1) Please provide revised permit text, maps and hydrology designs that take into <br />account that the borrow area, borrow area topsoil stockpile and pond 4 will be <br />deleted from the Fruita Loadout plan, that there will be three sediment ponds and <br />that sediment control for the portion of the railroad loop adjacent to the deleted <br />borrow area will not involve a sediment pond. <br />In the August 19, 2011 submittal, CAM revised the permit text. However, please also <br />revise the water depletion estimate in Section 2.04.11 on pages 2.04 -37 and 38 to <br />include only the three proposed sediment ponds. <br />The Division has no further concerns.
