In all,there was not even evidence of anyone driving in this area,besides an <br /> ATV, as would be required for the dumping of 2,000 gallons of liquid. <br /> The alleged dumping investigation we performed was our second site visit of the day. On our first visit we spent a <br /> lot of time looking at the various facilities, including the refuse piles, slot storage facility and loadout,and neither <br /> Brock nor I noticed anything out of the ordinary at that point. We spent almost three hours on our second visit, <br /> keying in on the areas that were in question,and did not see anything. At this point I would say that there is no <br /> evidence of illegal dumping at the Deserado Mine. <br /> PROCESSING WASTE/COAL MINE WASTE PILES—Rule 4.10 and 4.11 Drainage Control; Surface <br /> Stabilization; Placement: <br /> -Reclaimed refuse pile RP-1 was walked during the inspection. The refuse pile is well vegetated and stable. <br /> There is good perennial grass cover on the pile and a good amount of forage kochia,which was interseeded after <br /> the initial reclamation. There are very few shrubs on the pile. There were no erosional problems noted on the pile. <br /> -Refuse pile RP-2/3/4 was well graded and compacted at the time of the inspection. The site has positive drainage <br /> and there was no water pooling on the surface of the pile. There is some rilling on the outslopes of the pile. When <br /> these rills become larger,Deserado places rock into them to help stabilize them. <br /> -Refuse pile RP-5a was well graded and compacted at the time of the inspection. The pile has positive drainage <br /> and no water was pooling on the surface. <br /> ROADS—Rule 4.03 Construction 4.03.1(3)/4.03.2(3)Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br /> Maintenance4.03.1(5)and(6)/4.03.2(5)and(6)Reclamation 4.03.1(7)/4.03.2(7): <br /> -The mine access road is a paved road. The road was stable. <br /> -The haul road to the refuse piles was well maintained and stable at the time of the inspection. There was no <br /> problem with fugitive dust from the road and no ruts or erosional problems were noted. <br /> -The access road along the conveyor corridor was well maintained and stable at the time of the inspection. No <br /> ruts or erosional problems were noted on the road. , <br /> -The road spurs to the slot storage and the nitrogen injection plant were well maintained and stable at the time of <br /> the inspection. <br /> RECLAMATION SUCCESS -Rule 4.15, Rule 3: <br /> -We walked around the subsoil stockpile that was used to build up the berms along the haul road and access roads. <br /> The site was reseeded last fall. There is already good perennial cover on the pile. There is also forage koshia and <br /> a large amount of small shrubs that are emerging. There was little to no cheatgrass on the pile and very few <br /> annual weeds. <br /> SUPPORT FACILITIES-Rule 4.04: <br /> -The slot storage pad was stable at the time of the inspection. The outslopes of the fill are well vegetated and <br /> there were no signs of erosion.
