August 18, 2011 C-1981-018/Deserado Mine JRS <br /> GENERAL MINE PLAN COMPLANCE: <br /> -The operator was currently mining in longwall panel LWB-11. They are approximately 90%complete with the <br /> panel. The anticipated completion date for this panel is the end of October 2011. They will then be moving the <br /> longwall and begin mining longwall panel LWB-12. They operator has also completed the development work for <br /> the headgate for longwall panel LWB-12. This information was compared with the currently approved Map 120 = <br /> B-Mine Plan and found to be in compliance. <br /> OTHER(Possible Illegal Dumping Incident): <br /> At approximately 16:00 Brock Bowles and I received a message that there was a report of a possible illegal <br /> dumping incident at the Deserado Mine. I called Sandy Brown in the Denver office and she read and forwarded <br /> the incident report,taken by CDPHE. The report alleged that a containment structure around a diesel tank, <br /> antifreeze tank and other tanks had filled with rainwater and spills and was completely full. The allegation then <br /> stated that the water/fueUantifreeze mixture was put into a water trailer and ultimately dumped into a hole"up on a <br /> hill... into a hole dug between the silos"and"across CR 65 and dumped by the place where they load trains,near a <br /> refuge(sic)area"and that"a naturally occurring pond `in the back' may have been impacted". The report alleged <br /> that there was approximately 2,000 gallons that was approximately 80%rainwater and 20%diesel fuel and <br /> antifreeze. <br /> Brock and I returned to the site and arrived there at approximately 16:30. We contacted Scott Wanstedt and told <br /> him about the allegation of illegal dumping. He immediately took us to his supervisor,Jeff Dubert (the head of <br /> engineering)and Bill Lepro, an engineer at the site who does all required inspections and certifications. We told <br /> Jeff, Bill and Scott about the allegation of illegal dumping at that point. <br /> Jeff, Scott and Bill(BME)all agreed that there was"some"water and a small amount of diesel fuel, Lingo <br /> Sulfonate and possibly shield oil mixed with water in the tank enclosure at the D-portal tank farm. They stated <br /> that the diesel fuel(mixed with water)was removed from the enclosure and put in the waste oil storage drums. <br /> They said that the mixture was mostly water. They said that the remaining water was placed into a water tanker <br /> (trailer)and spread on the refuse pile. They stated that this water contained Lingo Sulfonate, which they use as <br /> dust suppression on their haul road. They said that they removed the remaining sludge material and moved it to a <br /> sump by the coal silos until it dried some then transported that to the refuse piles(RP-5a) for disposal. We then <br /> informed them that we would need to do a site visit to investigate the allegations. They said"fine, go where ever <br /> you need". We then got into the truck with Scott and started our field investigation. <br /> We first went to the coal silo area,where half of the material was allegedly buried. These silos are on a"hill" <br /> above the facilities area(on the coal prep plant bench). We did see the sump area that BME discussed to the <br /> northwest of the coal silos. While there was some wetness present,there was no diesel or oily appearance or smell <br /> evident at the sump location. We then walked around the coal silos and prep plant bench area and there were no <br /> recent disturbance areas that would have been indicative of recent excavation. There is no area"between"the <br /> silos, as they are connected by cement,with a cage and ladder on either side,to access the top of the silos. We <br /> found no evidence at or around the coal silos that indicated that any diesel fuel had been dumped buried there. <br /> Number of Partial Inspection this Fiscal Year: 1 <br /> Number of Complete Inspections this Fiscal Year: 1 <br /> i <br /> Page 4 of 22 <br />
