41
As we also discussed in our recent conversations, I understand it may not have been clear
where this TRO3 will leave JKS with regards to augmentation requirements and commitments
on this Permit. Following successful completion of the site reclamation in conformance with
this TR03, JKS will not have ANY impermissible post - reclamation water uses or losses on
site, nor ANY remaining long -term augmentation requirements for the site and the Permit.
As you noted in our conversation last Friday, the 19 I recognize this response letter is not
timely to allow the Division review time to make a positive finding in favor of this TRO3
application. As a result, I would request on behalf of JKS that the Division's work and
decision date be extended one week, from this Wednesday, August 24, 2011, to
Wednesday, August 31, 2011. Hopefully, this will allow adequate time to resolve any
outstanding questions, concerns or issues with regards to this TRO3 application.
Eric, once again, our thanks to you for all of your help and information on the Kauffmans'
Permits. Please feel free to contact me directly as you have any questions, or require
additional materials or information.
Respectfully,
DCS, Inc.
Daniel P.
