JJD AIR RESOURCE PROTECTION — Rule 4.17: Although there was a moderate volume of coal that had been stockpiled on the D -seam portal bench and on the coal stockpile bench, there were no problems with fugitive dust. The operator was cleaning out pond B and bringing the cleanings to the coal waste pile. Since dirt had been tracked onto the old highway from the haul truck, the operator cleaned up the dirt before it became a problem. There were no rail cars at the unit train loadout so no fugitive dust from loading operations was present. There were no problems with fugitive dust at the coal waste piles or at any of the other disturbed areas. There was very little standing water in the pond. The float was on the primary and there was no debris in the emergency spillway. The pond embankment was stable. The water level in pond C was at discharge stage. Although the gated valve was in the closed position, a very small trickle of water was discharging. It appeared that a small amount of debris was preventing the gate from fully closing. However, the discharge water was clear. The operator will fix the problem. Pond D had a little water in it but was not discharging. The riprap was in place in the emergency spillway and the gated primary was closed. Ponds J and K were dry. The ponds' embankments and inslopes were stable and discharge structures, including the pump at pond J, were in place.
