Mike Boulay
Rule 2.05.4(1) Reclamation Plan
64. Item resolved.
-14- August 19, 2011
65. DRMS met with representatives from CAM and J.E. Stover & Associates at their
offices on July 29, 2011 to discuss the status of the proposed borrow material
site and other items related to the application. Following this meeting on August
3, 2011 the Division received the following correspondence via e-mail from J.E.
Stover & Associates: "CAM -CO is going to remove the 10 acre borrow area from
the permit application. This should simply DRMS adequacy comments. CAM
will likely obtain necessary material from United Companies 15 road pit." The
Division has revised its adequacy review accordingly to reflect this change
of plans. Please update the permit application accordingly and ensure that
all permit text and Maps are consistent with regard to removing the borrow
area from the permit application package.
CAM - Comment noted, various pages and maps have been updated. Permit,
disturbed area and topsoil salvage quantities have changed and text has been
updated on pages 2.03 -6, 8 and 2.05 -25 and 32 and 2.10 -1.
65a. Item resolved.
Rule 2.05.4(2)(d) Removal, Storage and Redistribution of Topsoil, Subsoil, and Other
Material
66. Item resolved.
Rule 2.05.4(2)(e) Revegetation Plan
67 — 73. Items resolved.
74. CAM is not proposing a woody plant density standard for revegetation success.
Per Rule 4.15.8(7), for areas with a post- mining land use of fish and wildlife
habitat, minimum stocking levels, planting arrangements, and methods for
mitigation of potential adverse impacts must be determined on the basis of local
and regional conditions after consultation with and approval by the Colorado
Division of Wildlife (DOW). CAM must provide a basis for not reestablishing woody
plants; and documentation that DOW has been consulted and that DOW approves
of no shrub standard must be provided.
CAM Response: Please see revised page 2.05 -36. Revegetation success criteria
for the woody plant density for rangeland and fish /wildlife areas will be based upon
the greasewood reference area.
