Cotter Corporation (N.S.L.) <br />Cotter Corporation ( "Cotter") is a New Mexico corporation. Cotter is the <br />operator of, and, holds reclamation permit number M -1977 -300 ( "Permit ") for, <br />the Schwartzwalder Mine ( "Mine ") located in Jefferson County, Colorado. <br />II. Nature of <br />Cotter seeks judicial review of the Board's Order finding it in violation of <br />the Act, and of those portions of the Order requiring Cotter to dewater and treat <br />the mine pool and to bond for such actions. Cotter also seeks review of the <br />Board's imposition of civil penalties. Cotter does not dispute those parts of the <br />Board's Order requiring treatment of water reporting to Sump No.1 and posting <br />a bond for that treatment. <br />ules 3.2 and 3.3.
