CHRONOLOGY: <br />February 16, 2010 — The Division of Reclamation, Mining and Safety (Division) approved <br />Amendment 01 (AM01) for the Reese -Logan Sand and Gravel Pit which addressed changes to the <br />mining and reclamation plans, and required appropriate SEO permitting, due to the exposure of <br />groundwater on site. In conjunction with the approval of AM01, the bond for the site was <br />increased by $10, 575 from the prior amount of $6,925 for a new total bond amount of $17, 500. <br />The bond increase of $10,575 associated with the approval of AMO1 has not been posted to -date <br />by the permittee. <br />STAFF RECOMMENDATION: <br />Re- affirm the Division approval of AMO1 and require that the appropriate bond be posted within <br />30 days of the signed board order. <br />Corrective Action(s): <br />Require the Operator to submit approvable appropriate financial warranty as specified in the <br />DRMS amendment approval letter dated February 16, 2010 within 30 days of the signed Board <br />order. <br />Civil Penalty: <br />If the appropriate bond is not posted within 30 days of the signed Board order, the Division will <br />issue a Reason to Believe a Violation Exits letter to the permittee for failure to maintain a <br />financial warranty in good standing for the life of the permit as required by C.R.S. <br />34- 32.5- 117(6)(a) and Rule 4.1(7). If the Board then finds a violation, it could assess a civil penalty <br />in the amount of $100.00 to $1000.00 for each day of violation, depending on permit type, or order <br />the permit to be suspended, modified, or revoked.
