In conjunction with the approval of AMO1, <br />the bond for the site was increased by $10, 575 from the previous amount of $6,925 for a new <br />total bond amount of $17, 500. This increase in financial warranty associated with the approval <br />of AM01, as stated in the amendment approval letter to the operator dated February 16, 2010, was <br />not posted within 365 days. <br />As stated in Rule 4.1(2), failure to post the required warranty within one calendar year of the <br />approval of an application for any new permit, amendment or conversion requires the Mined <br />Land Reclamation Board to hold a hearing, in accordance with the notification and comment <br />provisions of Rule 1.6, to reconsider the previous Division approval. If the Board affirms the <br />original approval, the Board then shall establish a new deadline for submittal of the financial <br />warranty. If the required warranty is not posted by the date set by the Board, the (amendment) <br />application shall be denied.
