TECHNICAL REVISION NO. 1 <br />NELSON MINING RESOURCE DRMS PERMIT NO. M- 2005 -059 <br />ASPHALT SPECIALTIES CO., INC. ( "ASCI ") <br />Based on a routine site monitoring inspection performed by the DRMS on June 16, 2011, maintenance <br />and stabilization issues were found to be out of compliance with the DRMS mineral rules and regulations <br />for the approved permit on the Nelson Mining Resource gravel mining operation site. The site has not <br />operated in a significant manner since February 2009, with mining, production or reclamation activities <br />due to the continued slowdown of the need for construction aggregates. Based on the conditions noted <br />during the site inspection, this Technical Revision ( "TR ") No. 1 has been prepared to address the <br />Corrective Actions required by the DRMS to eliminate a current weed infestation problem, develop a <br />weed control plan and to revegetate topsoil stockpiles to preclude further weed infestation and to <br />stabilize and control erosion of topsoil material. <br />CORRECTIVE ACTION 1: There are state - listed noxious weeds currently on the permit area primarily <br />located near the entrance, around the scalehouse /office and some distance further down the entrance <br />road to the north. There is also an area of recent Tamarisk invasion located to the south of the plant <br />area. A weed control plan had been developed only as part of the permit approval for control of weeds <br />after final reclamation in areas of native grass revegatation. A weed control plan shall be developed and <br />implemented for the site during mining and reclamation activities. <br />RESPONSE TO CURRENT WEED INFESTATION: Weeds currently on the site in the areas described <br />above will be sprayed with herbicides by a professional company from Longmont who ASCI has <br />used before for these activities on mine sites in the area. A copy of the paid invoice will be <br />provided to the DRMS to show that this work was completed. The area of the entrance, <br />scalehouse and entrance road will be treated with "Vista" and "2, 4 -D ". Cheatgrass will be <br />specifically treated with "Plateau ". Tamarisk treatment will consist of cutting the shrubs to the <br />stump and treating the stump with "Habitat ". This action will be completed in September to <br />early October 2011. <br />RESPONSE TO WEED CONTROL PLAN: Since a weed control plan was never developed as part of <br />the permit approval for this site during active mining and reclamation, only for post -final <br />reclamation maintenance, ASCI commits to monitoring all areas within the permit boundary for <br />weed infestation and to control areas that have been invaded by state - listed noxious weeds by <br />mowing, tilling prior to seed fall, or in the case of small, isolated areas of intense infestation, <br />treating with herbicides as described above for the current situation. Upon completion of final <br />reclamation activities, the approved weed control plan for post -final reclamation and <br />maintenance of the revegetated areas will take effect. <br />
