PUBLIC NOTICE <br />Notice of an Application to Amend Mine Reclamation Permit No. M- 2002 -4 <br />Applicant Name: GCC Rio Grande, Inc., 3372 Lime Road, Pueblo, CO 81004 Phone: (719) 647- <br />6800, has filed with the Colorado Division of Reclamation, Mining and Safety, an Application to <br />Amend the Regular 112 Operation Mining Permit No. 1VI -2002 -004 owned by GCC Rio Grande, <br />Inc. This application for amendment seeks to modify the Reclarnation Plan (Exhibit E) and <br />Reclamation Cost (Exhibit L) of the Pueblo Cement Plant and Limestone Quarry. Additionally, <br />this amendment updates the cement plant site plan and transmits copies of as built drawings. <br />The addition and modification of structures has not resulted in any changes to the Permit <br />Boundary. No other amendments to the Permit are proposed. <br />This Amendment is in response to the zoning interpretation issued to clarify and interpret the Rio <br />Grande Special Use Permit No. 1999 -002 ( "SUP 1999- 002 "), Pueblo County, Colorado. <br />Specifically, clarification is provided with regard to the nature and duration of the cement <br />manufacturing use permitted under SUP 1999 -002. SUP 1999 -002 permits (i) mineral extraction <br />and accessory processing activities and (ii) cement manufacturing. Upon the cessation of all <br />extraction activity, SUP 1999 -002 requires the reclamation of only those lands used for mineral <br />extraction and accessory processing activities. Conversely, SUP 1999 -002 does not require <br />reclamation of the land used for cement manufacturing; rather, SUP 1999 -002 contemplates and <br />provides for the continued and perpetual use of the cement manufacturing plant. <br />Legal Description: The Regular 112 Operation Mining Permit No. M- 2002 -003 property is <br />generally located in Sections 13, 23, 24, 25/18, 19, 30 Township 22 South, Range 64 and 65 <br />West, 6 P.M. Generally, this location is approximately six miles south of the City of Pueblo, <br />Colorado. <br />The name of the legal owners of record of the surface and subsurface of the permit area are the <br />State of Colorado and GCC Rio Grande, Inc. <br />This Amendment to the Application is available for inspection at the Colorado Mine Land <br />Reclamation Board, and at the office of the Pueblo County Clerk and Recorder. <br />The operation commenced in June, 2005 and is a continuing operation. <br />Written Objections to the Amendment to Application are due not more than twenty days after the <br />date of last publication of notice pursuant to C.R.S. § 34- 32- 112(10).
