July 21, 2011 Mr. Eric Scott, PG Environmental Protection Specialist Colorado Division of Reclamation, Mining and Safety (DRMS) 1313 Sherman Street, Room 215 Denver, CO 80203 RE: DRMS Permit M -4999 -069, Wagner /Kauffman Pit #3 Technical Revision (TR) Req_uest Eric: 7 RECEIV 25X O11 ,../.. of Reclamation, Mining and Safety Thank you for meeting with Frank and Mary Kauffman, as well as myself and Todd Williams, at your office on May 24 this Spring regarding this Permit. It was helpful for us to review the reclamation status and progress at this site, as well as to discuss upcoming plans and requirements with you and Tony Waldron. At the meeting, we reviewed reclamation progress on the Boyd Lake Avenue embankment, the Kauffman east reservoir liner, and revegetation at the east end of the site. We also talked about the Kauffmans' plans for lining the west reservoir, which is currently being mined out as the final phase of the mining operation. More specifically, we noted the following particulars: • the Boyd Lake Avenue roadway embankment construction for and by the City of Loveland was sufficiently completed to completely enclose the east reservoir; • the reservoir liner construction is complete on the east reservoir; • the east property revegetation is within one additional year of final planting, and two years of complete grow -in ready for final release; and • reservoir liner construction is ready to begin on the west reservoir. Through the course of the meeting, we discussed some of the more notable aspects of these developments: 1. Most significantly, the east reservoir liner construction is now entirely complete, and no groundwater infiltration nor dewatering has been required for the month of July. The Kauffmans still have significant claystone bedrock excavation work remaining, to deepen the floor of the reservoir. The State Engineer's Office has indicated that no excavation activities are allowed while the 90 -day infiltration test is in progress, so the infiltration test can't be conducted until the bedrock excavation is complete.
