Colowyo, C1981 -019, PR3 adequacy No. 3 7 July 22, 2011 <br />Rule 2.04.11 Fish & Wildlife Resources Information <br />1. As per Rule 2.04.11(2), the applicant shall contact the Division of Reclamation, Mining and <br />Safety to determine what fish and wildlife resources information will be required. While it <br />appears that a thorough fish/wildlife study and report of the Collom Permit Area are included in <br />the permit, there is not a discussion in the text about any pre -study contact with the Division to <br />determine the required data for the study. Please submit a copy of correspondence with the <br />Division as to the information required for a complete fish/wildlife study at the Collom Permit <br />Area and also include a discussion of these required data in the text. Any pre - permit <br />correspondence from the Colorado Division of Wildlife (CDOW) would also be helpful. <br />Colowyo provided letters from interaction with CDOW dated December 14, 2005, regarding <br />pre- application communication and coordination between CCC and CDOW. As per Rule <br />2.04.11(2), the applicant shall contact the Division to determine what fish and wildlife <br />resources information will be required. While it appears that a thorough fish/wildlife study and <br />report of the Collom Permit Area are included in the permit, there is not a discussion in the <br />text about a pre -study meeting with the Division to determine the required data for the study. <br />The Division feels that Colowyo's response is adequate; however, please incorporate into the <br />permit text that the Division deferred to CDOW for creating a scope of work. Also include <br />CDOW's letter approving Cedar Creek's scope of work for the Collom Expansion Area. <br />CC( e letter into the rev in Ieeticm <br />' 11-1.1 I. this respan.c is udeyuutc. <br />2. Incorporate the findings from the CDOW (letter dated Feb 17, 2011) into the text to add the <br />wildlife baseline knowledge of the Collom Expansion Area. <br />Item Resolved <br />Rule 2.04.12 Prime Farmland Investieation <br />1. In Section 2.04.12 of the application, CCC states that the USDA - Natural Resource <br />Conservation Service (NRCS) made a negative determination in 2002 regarding the presence of <br />prime famdand in the permit expansion area. Please provide documentation, for inclusion into <br />the permit, from the NRCS regarding the negative determination of prime fam Iand.JHB <br />CCC provided 3 copies of a letter from NRCS, Craig Field Office, dated March 23, 2011, <br />stating that the NRCS has made a negative determination for the existence of Prime Farmlands <br />within the proposed Collom Expansion Area Permit Boundary (PR3). This response is <br />acceptable. CCC, however, has not designated where in the permit this letter should be <br />included. Please instruct the Division as to placement of the NRCS letter into the permit. <br />CCC', response is acceptable. <br />
