Pineda <br />Director <br />The Division of Reclamation, Mining, and Safety has begun the review process of the above referenced <br />Notice of Intent (NOI). The following issues need to be clarified or corrected in order for the NOI to be <br />considered complete and accepted, <br />1. The application notes 0 acres of disturbance. While it is understood that the proposed holes are <br />in exisiting roads there are still disturbances at each site which must be addressed. There will be <br />support vehicles that pull up and around the drill for fueling, core loading, etc. The application <br />notes silt fencing that if installed correctly will create surface disturbances. The financial <br />warranty must include removal and reclamation of these areas. These are just a few <br />disturbances common for such projects. 0 area disturbance is not accepted and the Division is <br />requesting a reassessment of the disturbance area. The applicant should provide <br />documentation from the Forest Service supporting the area of disturbance assessment for <br />consistency. <br />2. Page 6, (11) and Attachment B, (3) note exisiting roads will not need reclamation but then notes <br />that roads designated for Forest Service decommissioning will be. Please provide <br />documentation for Forest Service specifications of the proposed work, and written acceptance <br />from Forest Service of this proposal. This information is necessary for the Division to calculate a <br />financial warranty amount. <br />3. The notification process is not correct. The Division cannot accept e-mails as a form of public <br />notification for any process. The applicant must submit a certified letter receipt, physically <br />signed, and dated receipt, or a signed letter of receipt. The Forest Service notification is <br />accepted. However per Rule 5.1.2(m), the applicant must notify the Gunnison County <br />Commissioners. Please provide proper proof of notification to Gunnison County Commissioners. <br />4. Please provide written Forest Service approval or acceptance for the housing for the crew <br />proposed in Attachment B, (4). This information may be necessary for the Division to <br />incorporate into calculations for the financial warranty amount if the Forest Service has <br />additional requirements or stipulations. <br />5. Attachment C and G note that a water rights application has been submitted for water to use on <br />this project.
