EXHIBIT (Water Information) <br />The limestone Pit No. 10 is not expected to directly affect surface or ground water systems. <br />There are no water rights, or water resources on the project. Any water to be used for dust <br />control or drilling uses will have to be hauled from established sources off -site. Moffat County <br />will mine and crush limestone for storage, about once every five years. During each mining and <br />crushing phase of the operation, Moffat County will produce 15,000 cubic yards of road base <br />materials, and will haul approximately 15,000 gallons of water from our pump site near <br />Maybell, CO for dust control in each event. <br />Moffat County will apply for an (NPDES) permit from the Water Quality Control Division, once <br />we establish the final location of our limestone mining area. <br />Moffat County will control stormwater by diverting it away from the natural channels in the <br />construction areas, and will develop berms, ditches, and settling basins to manage the <br />sediment and to control erosion. This project will not intentionally divert stormwater for <br />beneficial use, or affect the "Waters of the State of Colorado and of the United States." <br />Local surface water may settle in low areas of the excavations, and, if such water collects in a <br />substantial way, or if it becomes impounded for a substantial period of time, we will notify the <br />Colorado State Land Board, and we will recommend that they apply to the Colorado Water <br />Court for a water storage right — then apply the water to beneficial use. <br />In the event ground water is exposed, Moffat County will backfill the excavation so as not to <br />expose groundwater until a well permit has been obtained for the pit well pursuant to CRS 37- <br />90-13. <br />Moffat County will comply with all of the NPDES rules from the Water Quality Control Division <br />at the Colorado Department of Health, where necessary. <br />
