The shares "available" to the mine per <br />each property are shown in the permit. However the number of shares "available" <br />is not relevant to demonstrating reclamation success or comparable management <br />between the reclaimed and reference areas. <br />b) Since SL -12 was applied for in August 2009, and PR -06 was approved in <br />December 2010, PR -06 has no bearing on SL -12. Bond release applications are <br />evaluated based on the permit in place at the time of application. <br />c) SL -12 is a bond release application for reclaimed irrigated pasture of 126.1 <br />acres. However, the total area that is irrigated on the New Horizon Mine changes <br />from year to year. In 2007 it was 242 acres and in 2008 it was 257 acres. These <br />areas include both the SL -12 areas and additional irrigated pasture in each year. <br />Again, as shown in the bond release documents, the area of irrigated pasture being <br />release is 126.1 acres. <br />d) The irrigation water flows into the West Lateral Ditch which flows to the New <br />Horizon Mine property, through various takeoff points. At these points, the takeoff <br />ditch or pipeline is measured using standard procedures (diverter box opening <br />width or flow meter) to determine flow, and then volume for the season.
