expansion area of the pile were in good condition. The upper haul road to Areas 2, 3 and 4 of the refuse <br />pile was also in good condition. <br />It did not appear that Bower Brothers Construction had stockpiled any new topsoil and cover materials. In <br />addition, they had not completed any further construction of the new haul road to the south of the existing <br />pond or the underdrain during this period. <br />As suggested, the water levels in the monitor wells installed on October 23, 1997 and December 9, 1999 <br />were measured during this quarter on a monthly basis. A table and graphs showing the monthly water <br />levels are attached. The water levels in Monitor Well N increased significantly from readings on April 8, <br />2011 and May 10, 2011. The water level went from 32.04 feet to 18.98 feet. The water level went down to <br />21.66 feet on June 8, 2011. The water level rise is likely due to record breaking runoff and precipitation <br />this past spring. It should be noted that this area received precipitation 27 of 30 days in April alone. We <br />recommend that the monitor well be observed closely to determine if the water levels return to normal <br />levels. <br />We were advised that the wash plants had produced approximately 31,436 tons of waste coal during the <br />month of April 2011: approximately 40,595 tons during May 2011: and approximately 79,211 tons during <br />June 2011. It is our understanding that the fines being produced at the wash plant, which consists of <br />approximately 10 to 20 percent of the total materials being produced, are being pumped underground into <br />the mine. <br />Based on our limited observations and compaction test results, it appears that the pile is currently being <br />constructed and maintained in general accordance with the project specifications and plans submitted under <br />2.05.3(8) and that the potential hazard to human life and property at the site in its present condition is <br />minimal.
