Pirieda <br />Director <br />Re: Schwartzwalder Mine, Permit No. M -1 977 -300, Technical Revision TR -18 Adequacy Review - <br />Revised <br />Dear Mr. Whicker: <br />The Division of Reclamation, Mining, & Safety (Division) sent to Cotter Corporation (Cotter) on 23 May <br />2011 a preliminary adequacy review of Technical Revision (TR) Request TR -18. Based on subsequent <br />meetings and correspondence, it is now mutually agreed that the plan submitted by Cotter in TR -18 was <br />conceptual in scope and not progressed sufficiently to allow response to the Division's adequacy review. <br />Henceforth, Cotter requested and was granted an extension for the TR until 5 August 2011. The Division <br />hereby provides the following Revised Adequacy Review which presents the issues that must be addressed <br />before the TR can be approved. This letter supersedes the adequacy review letter sent by the Division dated <br />23 May 2011. <br />The Division has also been made aware that portions of the proposed pipeline, associated structures and <br />ground disturbance activity fall outside of the current permit area near the downstream terminus of the <br />pipeline and associated cutoff structure. Therefore, Cotter will be required to submit an Amendment to add <br />the necessary additional acreage required to contain the pipeline, associated structures, and ground <br />disturbance. The approval of TR -18 will be conditional and subject to the stipulation that the Amendment be <br />approved and financial warranties for both the TR and the Amendment be posted before any activity may <br />proceed that is inside the acreage to be added under the new Amendment. <br />Adequacy requirements: <br />1) Provide a map that, at a scale that displays appropriate detail, depicts the mining reclamation permit <br />boundary in relation to the proposed diversion structures. Appropriate detail should be sufficient for the <br />Division to determine whether the disturbance necessary for the diversion structure construction can and will <br />be accomplished within the affected area boundary. <br />2) Provide a detailed construction schedule for all components of the diversion structure and any preparatory <br />activity such as coffer dams, temporary diversions, etc. <br />3) Provide the proposed thickness of the 42 -inch diameter welded steel pipe. <br />4) Indicate whether there will be an access road along the length of the pipeline for maintenance and its <br />location with respect to diversion structures and the permit area. <br />Office of Office of <br />Denver • Grand Junction • Durango Active and Inactive Mines <br />Mined Land Reclamation <br />
