This report documents observations concerning compliance with the terms of the permit <br />and applicable rules and regulations of the Mined Land Reclamation Board. <br />The following inspection topics were identified as having Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPICS: RV, SC, RS <br />PROBLEM /POSSIBLE VIOLATION: Problem: Revegetation has not been established to the standards required in <br />§34- 32.5- 116(4)(f) C.R.S. and Construction Materials Rule 3.1.10(1), which state: "In those areas where <br />revegetation is part of the reclamation plan, land shall be revegetated so that a diverse, effective, and long - <br />lasting vegetative cover is established that is capable of self- regeneration and is at least equal, with respect to <br />the extent of cover, to the natural vegetation of the surrounding area. Species chosen for revegetation shall be <br />compatible for the proposed post- extraction land use and shall be of adequate diversity to establish successful <br />reclamation." The inadequate revegetation has resulted in erosional instability and sediment transport with <br />formation of erosional rills. <br />CORRECTIVE ACTIONS: The operator must establish revegetation in accordance with §34- 32.5- 116(4)(f) C.R.S. <br />and Construction Materials Rule 3.1.10(1) in order to provide the appropriate required extent of cover, <br />adequate vegetative diversity, and to prevent erosional instability. The operator must also repair to the extent <br />possible the existing erosional damage by regrading. <br />CORRECTIVE ACTION DUE DATE: 23 June 2012 <br />Page 1 of 7 <br />
