Rule 2.03.9 — Insurance Information <br />3. Exhibit 2.7 -1 contains the Cola Ridge Mine's insurance certificate and insurance <br />information. The insurance certificate in the exhibit has an expiration date of 7 <br />July 2000. The Division is in possession of an up -to -date insurance certificate, <br />with an expiration date of 12 July 2011. Please update the information <br />contained in Exhibit 2.7 -1 to include, at a minimum, an up -to -date insurance <br />certificate. <br />Rule 2.03.10 — Identification of Other Licenses and Permits <br />4. Permit Section 2.8.1 contains information regarding the Garfield County special <br />use permits. The text states that the two permits have expired. Please provide a <br />narrative and documentation confirming that these Garfield County special <br />use permits are no longer required for the Coal Ridge mine <br />5. Permit Section 2.8.3 contains information regarding the Colorado Department of <br />Public Health and Environment's Colorado Wastewater Discharge Permit. The <br />text states that the CDPS permit expires on 30 June 2007. The 2010 Annual <br />Reclamation Report, received 5 January 2011, states that the CDPS Permit was <br />granted inactive status on 30 September 2004. Since the permit was made <br />inactive it is assumed that a new permit was never applied for or issued upon its <br />expiration on 30 June 2007. Please update the CDPS Permit information in <br />Section 2.8.3 to reflect the current status of the CDPS Permit. <br />Rule 2.04.4 — Cultural and Historic Resource Information <br />6. The Division received a comment letter from the State Historic Preservation <br />Office (SHPO) dated 1 April 2011. The letter states that SHPO finds that no <br />historic properties will be affected as a result of the Coal Ridge Mine's RN -06. <br />No further action is required by Coal Ridge. A copy of the SHPO letter is <br />attached for your review. <br />Rule 2.04.7 — Hydrology Description <br />7. The Division received a comment letter from the Division of Water Resources <br />(DWR) dated 25 April 2011. The letter states that since the remaining sediment <br />pond at the Coal Ridge Mine is in an over - appropriated stream system, any water <br />that may be contained in the pond is subject to administration and must be <br />released within 72 hours of impoundment. Permit Section 4.3.4 contains <br />information regarding the remaining sediment pond, Pond A. Please add a <br />discussion of how Coal Ridge will comply with the DWR requirement that <br />any impounded water be released within 72 hours. A copy of the DWR letter <br />is attached for your review. <br />
