Hatcher Page 5 of 7 <br />June 22, 2011 <br />A monthly breakdown of depletions and replacements is shown on the attached Table 4 <br />that was submitted with your report. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid for the period of April 1, 2011 through March 31, 2012, unless <br />otherwise revoked, modified, or superseded by decree. If this plan will not be made <br />absolute by a water court action by the plan's expiration date, a renewal request must be <br />submitted to this office with the statutory fee (currently $257) by February 15, 2012. <br />2. Well permit no. 63693 -F was issued in accordance with C.R.S. § 37 -90- 137(2) and (11) <br />and is valid for the current uses. The Applicant is required to maintain a valid well permit <br />for the current uses at this site. <br />3. The total surface area of the groundwater exposed at the Hokestra Pit must not exceed <br />67.9 acres (exposed after December 31, 1980) resulting in a maximum annual evaporative <br />loss of 173.3 acre -feet. <br />4. The reclaimed area irrigated from the lakes shall not exceed 5.65 acres with a <br />consumption not to exceed 9.65 acre -feet. <br />5. Total consumption at the Hokestra Pit must not exceed 182.9 acre -feet per year, unless an <br />amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses for which <br />the water may be used must first be approved by this office. <br />7. The replacement water that is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply plan, <br />the replacement water must be appurtenant to this site until a plan for augmentation is <br />obtained. All replacement water must be concurrent with depletions in quantity, timing <br />and locations. <br />8. All diversions into and out of the 112 Pit shall be measured in a manner acceptable to <br />the division engineer or water commissioner. The applicant shall install and maintain <br />such measuring devices as required by the division engineer or water commissioner for <br />operation of this plan. <br />9. The replacement water must be returned from the Rural Ditch to the St. Vrain <br />River through a turn -out structure approved by the Water Commissioner, <br />preferably the existing farm diversion point on the ditch used to divert water to the <br />historically irrigated lands. Since a turn -out structure has not been installed on <br />the Rural Ditch, for the purpose of this SWSP the applicant is proposing to run the <br />3.75 shares of the Rural Ditch through Varra Pit No. 112, use the measuring device <br />already install in the 112 pit, and return the shares back to the river for <br />replacement. This proposal is accepted for this SWSP, however for any <br />subsequent renewal request the applicant must demonstrate to the satisfaction of <br />the water commissioner that a turn -out structure has been installed on the <br />existing farm diversion point on the ditch used to divert water to the historically <br />irrigated lands. <br />
