Colowyo has the following responses: <br />SECTION 1 <br />General Discussion <br />The text in the permit application indicates that sediment in sediment ponds will be <br />surveyed (page 4.05-14). In 2010, was this survey completed? If not, please explain why <br />this was not necessary. <br />Response: Colowyo completes estimated sediment surveys on all sediment ponds on a <br />quarterly basis. These surveys were submitted to Mr. Jim Stark on April 9, 2010, July 6, <br />2010, September 14, 2010, and January 7, 2011 respectively. <br />Data from DMRs was not provided in the AHR, but a review of this data was deemed to <br />be important when assessing CCC water quality. Therefore DRMS reviewed this data <br />and found that there was only one day all year when parameters exceeded effluent <br />limitations in the CDPHE permit: on May 4, 2010, there were elevated level of Iron in <br />discharge from Prospect Pond (CDPS point 007A) and elevated level of TSS in discharge <br />from West Taylor Pond (CDPS point 011A). Please explain if a report was filed with <br />CDPHE, or, if not, why it was not filed. <br />Response: A waiver request under the alternative limitations for the elevated Iron level <br />was submitted to CDPHE for the May 4, 2010 sample from Outiall 007A.
