Mr. Kent Gorham <br />June 3, 2011 <br />Page 4 <br />NECC response: In addition to the wells NE1-10 and NE-6-10a, 10b added for <br />monitoring in TR56, wells from the Golden Eagle Mine permit C1981013 are requested <br />to be transferred to this permit (page 2.05-90f). The monitoring schedule for NM20, <br />NM21, NM22, NM 23 and SF-2 is listed in Table 27 page 2.05-90b. The reclamation <br />bond estimate for the transferred wells is included in Exhibit 28 pages 176-179. Map 8 <br />has been revised for purposes of format consistency. <br />11. DRMS: Please find attached a letter from the Division of Wildlife. The Division of <br />Wildlife is concerned about the additional disturbance and excavation required to protect <br />water and gas pipelines under the plan proposed in Exhibit 24 for subsidence control and <br />mitigation. The disturbance, the extent of the disturbance, the length of time that <br />excavated areas would be exposed, hazards of same to wildlife and to users of the <br />roadways, and final reclamation of the disturbance are their primary concerns. Please <br />provide a response in the form of additional information as required as part of Exhibit 24 <br />or as permit text narrative under Rule 2.05.6(6). <br />NECC response: Exhibit 24 has been updated to show protection of the pipelines by <br />leaving a corridor under which no pillar recovery will occur. The pipelines will be <br />undermined and pillars left in place for protection of the pipelines. Permit pages 2.05-91, <br />92, and 93 have been modified to reflect the expanded permit boundary. <br />Rule 2.10 Mans and Plans <br />12. DRMS: On Map 5, please modify the legend to properly display the stratigraphic order <br />of the formations with the Pierre Shale being the oldest formation, followed by the <br />Trinidad sandstone. <br />NECC response: Map 5 has been corrected as requested. <br />13. DRMS: On Map 6A -3, Apache Seam Thickness, the detail is showing the Maxwell <br />seam outcrop. Similarly, on Map 6A-4, Apache Seam Coal shows the Maxwell seam in <br />the detail. <br />NECC response: Map 6A-3 has been corrected as requested <br />14. DRMS: All the 6A series of maps refer to an "Existing permit boundary" and "Permit <br />boundary". Once these maps are approved, this will create confusion. Please identify <br />features assuming future approval. A "permit boundary" is all that is required. <br />NECC response: The Map 6A series have been corrected to refer to the "permit <br />boundary". All references to the existing permit boundary have been removed. <br />15. DBMS: All of the 6A series of maps are not showing the projected sections into the <br />permit area. Please add this important information to this series of maps.
