Response to CN-01 Third Adequacy Issues - June 6, 2011 <br />Response #40 <br />Wildcat Mining is submitting a revised Environmental Protection Plan which includes the <br />certified design specifications meeting the requirements of Rule 6.4.21(10)(a)(iii) See <br />Attachment J. Wildcat Mining will convey water to and from the Idaho Spring and the <br />Augmentation Pond in compliance with it DWR water rights requirements The <br />augmentation pond will not contain pr;,cess water. The pond is designed to comply with <br />Division of Water Resources where raw surface water (surface or groundwater) will be <br />stored and release if or when a "call" on the water is requested by the Division of Water <br />Resources. (See Wildcat Miring Corporation-Water Right stipulations-2007) <br />Adequacy Issue #41 <br />The Division previously stated Operator responsibility for shipments of fuel, lubricants and <br />chemicals commences at the permit boundary. The transport route across the permit area <br />includes steep road grades, a crossing of the La Plata River, crosses wetlands and tributaries for <br />the La Plata River, and passes within approximately 100 feet of several domestic wells. The <br />Division requested the Applicant to describe how fuel, lubricants, industrial chemicals and <br />designated chemicals will be transported from the mine entrance to the mill facility in a manner <br />which protects surface and ground water systems from an unauthorized release of pollutants and <br />protects off-site areas from damage. <br />The Applicant's response directed the Division to Attachment K. There was no Attachment K <br />provided in the Applicant's response received April 18, 2011. Please provide Attachment K. <br />Response #41 <br />See Attachment D (Stormwater Management Plan) and Attachment J (EPP) <br />Adequacy Issue #42 <br />Regarding the requirements of Rules 6.4.21(19) and 3.1.7, please see the review memorandum <br />from Mr. Bird. <br />Response # 42 <br />Wildcat Mining is submitting as Attachment M its response to the Bird Memorandum <br />Revised <br />6/6/2011 <br />29 <br />
