Response to CN-01 Third Adequacy Issues - June 6, 2011 <br />Adequacy Issue #27 <br />The application states the mill facility and steel sets at May Day 1 level will be dismantled to the <br />maximum extent possible. Please clarify, "maximum extent possible." If there exists a safety <br />hazard in removing the inner most steel sets, affixed to or under cutting the native ground of the <br />highwall, please state such. Otherwise, please revise the reclamation plan to indicate total <br />dismantlement of the mill facility, steel sets and rubblization of the concrete floor and foundation <br />for the mill facility. The Division cannot approve burial of intact surface structures as permanent <br />reclamation. The Division considers the mill building to be a surface structure, with or without a <br />soil cover. <br />Response #27 <br />Wildcat Mining is submitting a revised reclamation plan to indicate the total <br />dismantlement of the mill facility, steel sets and rubblization of the concrete floor and <br />foundation for the mill facility. See Attachment L These materials will be recycled or <br />buried in dry underground mined out areas <br />Adequacy Issue #28 <br />Regarding compliance with the ground water regulations, please see the review memorandum <br />prepared by Division staff member David Bird. Please address the adequacy issues identified by <br />Mr. Bird in his attached review memorandum, dated May 3, 2011. <br />Response #28 <br />Response to Mr. Bird's adequacy questions is included as Attachment M <br />Exhibit H- Wildlife, Rule 6 4 8 <br />Adequacy Issue #29 <br />Please ensure the application for CN-01 includes a copy of the recommendations from the <br />Colorado Division of Wildlife, as required under Rules 6.4.8(2) and 6.4.21(1). If the Applicant <br />believes the application already contains copy of the recommendations from the Colorado <br />Division of Wildlife (DOW), please clarify the date of the DOW document and specify the <br />location of the document within the application materials. <br />Response #29 <br />Wildcat Mining is providing a the letter presenting the comments and recommendations of <br />the Colorado Division of Wildlife ("DOW"), Durango Office, at Attachment N, as required <br />under Rules 6.4.8(2) and 6.4.21(l).
