Fourth Adequacy Response 112(d)-1 Application, Amended CN-01 Wildcat Mining Corporation May Day Idaho Mine Complex Response #4 The Company commits to repairing the above-described portion of the access road to the Incas Mine in the event this portion of the access road should fail. Adequacy Issue #5 In the Division's third adequacy letter, under adequacy number 16, the Division indicated review of the proposed Storm Water Management Plan (SWMP) was not yet completed. The Division is still reviewing the proposed SWMP, which was amended in response to adequacy issues previously raised by the Division Response #5 Stormwater Management Plan has been submitted as Attachment D to the Company's response to CN-01 Third Adequacy Issues. Adequacy Issue #6 In the Division's third adequacy letter, under adequacy item number 41, the Division indicated the documents received on April 18, 2011, did not provide an Attachment K. Such statement was in error. The Division has noted the amended CN-01 included an Attachment K, which contained Exhibit U, Environmental Protection Plan. The application materials submitted by the Applicant for CN-01 exceed 1,400 pages. The Division would appreciate the Applicant's cooperation in organizing and managing the application materials. Please simplify future submittals by avoiding the use of multiple and unnecessary layers of attachments, as well as attachment names which confuse the names of the Exhibits required under the Act and Rules. Examples of confusion in the amended CN-01 include, but are not limited to, the following: • Exhibit A, Legal Description, was located in Attachment D. • Exhibit C, Pre-mining and Mining Plan Maps, was located in Attachment J. • Exhibit D, Mining Plan, was located in Attachment E-1 of Attachment E. • Exhibit F, Reclamation Plan Maps, was located in Attachment C. • Exhibit G, Water Information, was located in Attachment H. • Exhibit M, Other Permits and Licenses, was located in Attachment E-3 of Attachment E. • Exhibit T, Permanent Man-Made Structures, was located in Attachment I. • Exhibit U, Environmental Protection Plan, was located in Attachment K. • Attachment E directed the Division to Attachment E-5 for portions of Exhibit 6.5 and Table 6.5-1, Chief Drainage Channel Flow Calculations. Attachment E-5 contained only one table, Table T5-1, Analyte Laboratory Test, which was not legible. Please submit an enlarged and legible version of Table T5-1.
